What is a case digest?
A case digest or a case brief is a written
summary of the case. A case sometimes involves several issues. Digesting the
same would help the student in separating one issue from another and understanding
how the Supreme Court resolved the issues in the case.
How to write a case digest?
Summarizing a case can become a bit tricky. First
thing first, read the whole text. You will encounter many issues as you read
the full text. Bear in mind what subject and topic, your professor wants to discuss
in class. When you are provided with a course outline, always be on the lookout
for that topic in the assigned case. From there, you can start building your issue
and the ruling.
What are the parts or the essential information in a
case digest?
A basic digest should contain three main parts:
(1) The Facts (2) The Issue (3) Ruling.
Some important information that you can put in
your case digests are: (1) Caption - must include the date it was decided and
citation; (2) The Facts - pinpoint the determinative facts; (3) Procedural
History - what has happened procedurally in the case, what did MTC, RTC or CA decide;
(4) Issues - must be answerable by yes or no; (5) Ruling – answerable by "yes"
or "no" base from the issue you pointed out; and lastly (6) The Concurring
and Dissenting Opinions of other Justices
The Ruling also contains the legal basis or the
provision of the law.
